The Labour Court amended an adjudication officer’s recommendation on National University of Ireland, Galway’s appeal, recommending an independent external investigation into a worker’s complaints. The decision was signed on 18 October 2016. The earlier recommendation called for the complaints to be sorted between grievance and anti-bullying procedures, then investigated externally. The University argued that the recommendation was impractical and that bullying complaints should use its Staff Anti-Bullying Policy. The worker sought an independent external investigator. The Court recommended appointing an independent external investigator, who would set the investigation’s scope and terms of reference with regard to University policies and fair procedures. The worker could remain in her Biochemistry role during the investigation.
