The Labour Court recommended that Irish Rail continue applying its 2012 night-working agreement to a worker, including for 2014 and 2015, until it was replaced or specific arrangements were agreed. The recommendation was signed on 17 October 2016. Irish Rail had appealed an Adjudication Officer decision on the Services Industrial Professional Technical Union’s claim that the worker was owed a night duty allowance. The union sought retrospective payment and continued application of the agreement; Irish Rail argued it did not apply to the worker’s role and location. The Court said agreements freely entered into should be honoured until a fresh agreement is made.
