The Labour Court recommended that Moorehaven Centre apply an unsocial-hours premium to relevant staff grades from 1 January 2015. It also recommended that the Centre and the Irish Municipal, Public And Civil Trade Union jointly seek funding for the cost. The recommendation was signed on 29 April 2016. The union argued that the Centre had failed to implement a Department of Health circular extending the premium to hours worked from 6pm, and that staff had received no premium since July 2013. The Centre said it had never paid a premium for work after 8pm and could not afford the allowance without additional funding. The Court noted that the parties linked staff pay to comparable HSE grades, which were entitled to a premium for hours worked between 8pm and midnight. It based its recommendation on that pay relationship and said both parties should approach relevant funding agencies for the resources needed.
