The Labour Court did not recommend conceding the Union Of Construction, Allied Trades And Technicians’ claim for a Dublin City Council worker to be appointed a Grade 6 Health and Safety Officer. The recommendation was signed on 11 April 2016. The union said the worker had performed the same duties as Grade 6 officers for nine years. The council said he had not competed for the post and lacked the recognised degree or diploma required for Grade 6 appointments. The Court noted that the worker’s grade and duties had been set by agreement in 2009 and that the role had not substantially changed. It also cited the council’s qualification requirement and the worker’s lack of that qualification.
