The Labour Court recommended that Tesco Ireland pay Dean Moran €6,500 compensation for earnings lost after a restructuring reduced his pay. The recommendation was signed on 4 April 2016, overturning the Rights Commissioner’s earlier recommendation that his claim was not well founded and should fail.

Moran had been a Section Manager until 2010, when he became a Team Leader on lower pay. He argued that he should be compensated and cited a colleague who had received compensation. Tesco Ireland said he had succeeded in an interview for a Line Manager role that would have protected his earnings, but chose the Team Leader role instead; it also said the colleague’s circumstances differed. The Court considered Moran’s case on its own facts after hearing contradictory accounts of the colleague’s case. It found compensation warranted and measured it to take account of both parties’ roles in the circumstances that led to his appointment as Team Leader.
