The Labour Court recommended restoring an unnamed worker to his former grade from 16 June 2016, or as soon as possible after, and reviewing his written warning from 16 January 2016. The Court varied an earlier recommendation on the worker’s appeal, dated 4 April 2016. The appeal concerned a final written warning and demotion imposed by Ocs One Complete Solution Limited after offensive messages about a colleague were found on an old phone. Services Industrial Professional Technical Union challenged the process, the use of information and the worker’s treatment compared with colleagues. The Court considered the events significant and said a severe response to proven incidents was warranted.
