The Labour Court upheld the appeals outcome in a dispute over a worker’s application for promotion to associate professor at University College Dublin. Its recommendation was signed on 13 January 2016. The worker, represented by IFUT, argued that his teaching and learning had not been meaningfully evaluated and that the process lacked transparency. UCD said its committees had fairly assessed his application and followed the agreed appeals procedure. The Court found no evidence of unfairness or unreasonable application of the selection criteria. It said it could assess whether the process was unfair or manifestly irrational, but could not substitute its view of candidates’ relative merit.
