The Labour Court recommended that Embankment Plastics Limited pay a former Quality Engineer €33,419.38 over his dismissal, citing egregious breaches of fair procedures. The recommendation was dated 23 October 2015.
The worker said he was dismissed after questioning a demand for unpaid extra hours. The company cited performance concerns, lateness and his refusal to work additional hours. The Court said it did not need to reconcile the conflicting accounts because of the fair-procedure breaches.
The worker was unemployed for 17 weeks, with a stated loss of €16,419.38 during that period.
