Labour Court declines INMO claim for 396 hours at HSE South

By Tadhg O'Sullivan

Historic decision · Decision date:

Place: no local area assigned from the source.

The Labour Court recommended that a worker covered by HSE South’s collective arrangements be included in any future agreement on moving to a 37.5-hour week. It did not recommend conceding the INMO’s claim for redress of 396 hours, which the union said were owed because the worker was denied access to the shorter week between June 2008 and July 2013. The recommendation was dated 11 March 2015. HSE South said hours could be reduced only on a cost-neutral basis and that no local agreement had been reached on revised rosters. The Court noted that the worker’s terms were set by collective agreement and that no agreement had been reached on how staff at the location would move to a 37.5-hour week. It recommended including the worker if such an agreement is concluded.
