The Labour Court recommended that the Commission for Energy Regulation reduce a worker’s final written warning to a first written warning, effective from 4 July 2014, and keep it on file for 12 months. It also recommended reviewing the disputed 5% increment under the employer’s commitment in an email to the worker. The recommendation was signed on 28 October 2014. The worker, represented by the Public Service Executive Union, said the disciplinary process was flawed and the sanctions disproportionate. The employer said the worker had failed to follow a legitimate instruction, the investigation followed procedure and the increment decision came through a separate performance process.
