Labour Court recommends €36,000 for care assistant unfairly dismissed

The Labour Court recommended that St Eunans Nursing & Convalecent Home Ltd pay €36,000 to a care assistant it found unfairly dismissed. The recommendation was signed on 15 October 2014. The worker said he was dismissed; the home said he resigned after serious allegations were investigated. The Court preferred the worker’s evidence and found that he had been dismissed on 21 February 2014. The Court found that the worker had not been told the allegations, given an opportunity to be represented, provided with witness statements, told his job was at risk or given a chance to defend himself. It said the dismissal fell short of basic procedural fairness and recommended €36,000 in full and final settlement of his claim.
