Labour Court recommends removing Stobart worker’s final warning

The Labour Court recommended that Stobart (Ireland) Driver Services Limited remove a worker’s final written warning from his file and confirm this to the union in writing. The recommendation was signed on 12 August 2014. The warning followed a dispute over a route change at the start of the worker’s roster that substantially changed his finishing time. The company argued the investigation and disciplinary hearing were proper and the warning had expired. The Court found little regard had been given to the worker’s reasons for being unable to accommodate the change, including the lack of prior notice, and said it was inappropriate to issue the warning.
