The Labour Court recommended that St Vincent's University Hospital and St Vincent's Healthcare Group Ltd pay a worker €7,500 and restart mediation to find her a suitable role after her transfer from nursing duties. The recommendation was signed on 12 May 2014. The worker was represented by the Irish Nurses Midwives Organisation.
The union said the worker was transferred after raising concerns about the relocated Orthopaedic Trauma Unit. Management said it moved her because of concerns about her performance and management of the unit.
The Court found management had acted precipitously and fallen short of procedural fairness and natural justice. It cited her removal from her duties, referral to occupational health after one day's absence, failure to complete mediation and the filling of her post while the issue was ongoing. The Court recommended that mediation be reactivated and completed within eight weeks, with the aim of finding a role suited to the worker's experience and skills. It also recommended €7,500 compensation in full and final settlement.
