The Labour Court recommended that HSE South restore Rose Barry and Eileen Mc Carthy to CNM3 grade no later than 12 months after the recommendation was signed on 26 March 2014. The nurses said they had transferred posts after St Mary’s Orthopaedic Hospital closed, relying on an assurance that they would regain their Night Superintendent status. HSE South cited financial pressures and public service reforms. The Court found they had been given an undertaking that they would return to their effective CNM3 Night Supervisor grade when the hospital reached full capacity, and had acted to their detriment in relying on it. It recommended restoration through engagement between HSE and INMO.
