The Labour Court recommended concession of a Community Allowance claim brought by PNA on behalf of a worker promoted to a Community Mental Health Nurse post at St. Brigid's Hospital, Ardee. The recommendation was signed on 19 March 2014 and was confined to the circumstances of this case. PNA said the worker reasonably expected the allowance after promotion and was not responsible for the recruitment delay. HSE Dublin North East said the allowance had ended for newly appointed staff from 1 February 2012. The worker won the promotion competition in 2011, but administrative formalities delayed his start until 20 February 2012. The Court found merit in the claim and recommended concession of the allowance.
