The Labour Court recommended against a worker’s claim to stop Tesco Ireland Ltd relying on a waiver clause in a redundancy agreement. The recommendation was signed on 6 March 2014. The Court said it could not interpret or otherwise deal with the agreement because it had been collectively agreed between Tesco and Mandate, neither of which was before it.
