The Labour Court recommended that HSE West continue applying agreed compassionate leave arrangements, adjusted to reflect the Civil Partnership and Certain Rights of Cohabitants Act 2010, while national negotiations continue. The recommendation was signed on 24 February 2014. The Irish Municipal, Public and Civil Trade Union relied on the existing collective agreement after HSE West issued Circular 016/2012. The Court said the circular, which had not been agreed with the unions, could not supplant the agreement. Management had argued that the HSE policy document had to be implemented.
