Labour Court rejects worker’s claim over HSE South promotional post

The Labour Court recommended against conceding a worker’s claim that a colleague was unfairly assigned a vacant promotional post at HSE South. The recommendation was signed on 24 February 2014. The Court noted that the events dated to 2007 and 2009 but the dispute was referred in 2013, with no reasonable explanation for the delay. It said the appointment procedure followed established practice and that, without a collective agreement setting out how posts should be filled, the employer could decide how to fill them.
