The Labour Court recommended that Boots the Chemist review its business requirements to ascertain whether they met the re-profiling requirements of its Work Life Balance Agreement. If those conditions applied, the worker should be offered the options in section 6 of the agreement. The recommendation was signed on 7 October 2013. The worker, represented by Mandate, said the agreement applied to all staff and that she was told it did not cover her when she sought the voluntary redundancy option. Boots said neither she nor her store had been re-profiled and no redundancy situation existed. Management accepted at the hearing that the agreement could apply if business needs required re-profiling. The Court cited serious communication failures about the agreement’s application.
