Labour Court says HSE South East must keep agreed compassionate leave terms

The Labour Court recommended that HSE South East continue applying its agreed compassionate leave terms, adjusted for the Civil Partnership and Certain Rights of Cohabitants Act 2010, while national negotiations continued. The recommendation was dated 17 September 2013. The Irish Municipal, Public and Civil Trade Union said a 2012 HSE circular had been used to diminish more favourable local arrangements. HSE South East said the circular standardised compassionate leave across the health service and superseded local arrangements. The Court found the circular had not been agreed with the relevant trade unions and could not replace the collective agreement.
