The Labour Court recommended that Special Olympics Ireland pay an unnamed worker €9,750 compensation after finding she was unfairly treated in the review of her suitability for employment and the termination of her job. The recommendation was signed on 23 August 2013.
The worker said she had been bullied and harassed, given unrealistic objectives and inadequate training, and unfairly dismissed. Special Olympics Ireland said her performance shortcomings persisted after probation reviews and denied there was evidence to support her claims.
The Court said no written bullying complaint had been made during her employment, so it recommended that the parties reflect on their working relationships and take appropriate steps to address any issues. It found that the termination procedure fell significantly short of good practice and that the worker suffered considerable financial loss as a result of the unfair treatment. The €9,750 was recommended as a full and final settlement of the dispute.
