The Labour Court accepted that IAA was entitled to act on its agreement with the Staff Panel for a random-testing protocol covering workplace intoxicants. The recommendation was signed on 4 June 2013. PSEU, AHCPS and CPSU argued that staff in non-safety-critical roles had not been consulted or agreed to the protocol. The employer said the Staff Panel had agreed to it and that it formed part of staff terms and conditions. The Court said unresolved union concerns should be raised with the Staff Panel and then taken through the procedures for union disputes if needed.
