The Labour Court recommended that EBS Limited pay the balance due from the 2011 13th month payment to non-management staff, following a claim by Unite on behalf of 300 employees up to assistant manager grade. The recommendation was signed on 25 April 2013. Unite said the payment was part of employees’ contractual core pay. EBS said it was a Christmas bonus and that losses prevented it conceding the claim. The Court considered the payment a bonus and said it could not recommend future payments because of the Placing Agreement. It recommended payment of the 2011 balance because the Minister’s position was not known until 29 December 2011.
