The Labour Court recommended that HSE Dublin Mid Leinster concede PNA’s claim for a Community Allowance for a Community Mental Health Nurse. The recommendation was signed on 18 April 2013 and was specific to this case. PNA said the allowance was paid to other nurses in the role and should be applied retrospectively. Management argued that the Public Service Agreement 2010–2014 ended allowances for new appointments. The Court found the agreement governing the allowance remained in place when the worker competed for the post and that it was not compensation for lost premium earnings.
