The Labour Court recommended that the result of a disputed control-room operator competition at Premier Periclase stand, in a recommendation signed on 16 April 2013. Unite argued the vacancy should have gone to a trained General Operative under the company-union agreement. The Court said company practice supported that view, but Unite knew the vacancy was open to all staff and that an electrician had been interviewed. It delayed objecting until after the result, so the Court said it could not challenge a process it had accepted. The Court also recommended that management confirm it would operate the agreement as clarified and that the parties review the agreement.
