The Labour Court recommended that Brookhaven Nursing Home offer a worker an opportunity to appeal an independent investigator’s report into her bullying and harassment allegations, with the right to representation. The recommendation was dated 22 February 2013. The investigator had found against the worker’s allegations. Brookhaven Nursing Home did not attend the Labour Court hearing. The Court said workplace dignity policies normally include an appeal mechanism and recommended that the worker be offered an appeal when she returned to work.
