The Labour Court recommended reducing a Delph Centre Ltd worker’s final written warning to a verbal warning. The recommendation was signed on 11 February 2013. The worker, represented by SIPTU, said the warning was excessive. Delph Centre Ltd said he had moved stock belonging to a client without permission. The Court found his conduct could not reasonably be described as theft or misappropriation. The Court found the worker had been sanctioned for an offence he was not given a chance to answer. It also found that the appeal to the company’s Financial Controller was not a fair and impartial review.
