The Labour Court recommended that two HSE West- County Clinic St Conal's Hospital employees acting in higher-grade roles be placed on the appropriate points of the Grade VI scale, based on their service in those roles. The recommendation was dated 16 November 2012. The Irish Municipal, Public and Civil Trade Union argued the employees were treated inequitably compared with workers in analogous grades who received incremental progression. The employer said they were paid correctly under policy and that the Public Service Agreement 2010–2014 precluded cost-increasing claims. The Court found no objective reason for the difference in treatment. The adjustment was to take effect immediately on acceptance, with no retrospective adjustment because of the HSE's financial circumstances.
