Labour Court recommends worker’s reinstatement at Enable Ireland

The Labour Court recommended that Enable Ireland reinstate a worker to her CE Supervisor position and provide a development plan, training and regular performance reviews. The recommendation was dated 7 November 2012 and followed her appeal against a final written warning and redeployment.

The worker, represented by the Services Industrial Professional Technical Union, argued that an investigation into alleged performance issues went beyond its terms of reference and included Individual Learning Plans. Enable Ireland said it had raised performance concerns before and that the investigation and sanction were appropriate.

The Court said the employer’s standards should have been met, but that a development plan and training should have come before disciplinary action. It noted that the final written warning had expired and been removed from the worker’s personnel file.
