The Labour Court recommended that Dunnes Stores rescind and expunge a worker’s written warning and review its disciplinary procedures. The recommendation was signed on 3 September 2012, following her challenge to a warning issued after a customer left goods unpaid at her checkout. The Court found that the warning had no retention limit and that the appeal was heard without a hearing by someone who reported to the store manager. It said the process breached the Code of Practice on Grievance and Disciplinary Procedures and denied the worker fair procedures. Dunnes Stores did not attend the hearing; Mandate Trade Union represented the worker.
