Labour Court rejects worker’s regrading claim against Kilkenny Borough Council

The Labour Court recommended that a worker’s extra duties did not justify regrading to Revenue Collector, but asked Kilkenny Borough Council to give him proper notice of proposed changes to his work. The recommendation was signed on 17 July 2012. SIPTU sought the higher grade, citing collections from 64 parking meters, lodging money, servicing three barrier car parks and travel between locations. The council said a settlement had already placed the worker at the top of the Foreman’s pay scale. The Court found the increased workload was normal ongoing change under the employment contract and did not justify the grade claim. It also noted he was not required to answer calls outside his normal Monday-to-Friday working week. The Court said the council had fallen short in advising him about proposed changes and recommended proper, timely and adequate notice.
