The Labour Court recommended that Dublin Institute of Technology examine a worker’s academic history and apply any resulting incremental-credit adjustment retrospectively, but did not recommend conceding the broader union claim. The recommendation was signed on 27 March 2012. The worker, represented by TUI, sought credit for previous experience when appointed as a full-time Assistant Lecturer. The Institute said he had been correctly placed at the first point of the salary scale and was not entitled to additional credit. The Court noted that DIT’s 2009 policy generally placed new appointees at the first salary-scale point, which adversely affected the worker. It said the policy change was a collective issue for unions and management, and found no evidence it had been applied inconsistently. The Institute had undertaken to review the worker’s academic history in Cyprus under Circular Letter IT 01/05.
