The Labour Court recommended that a worker represented by PNA be considered for future acting-up opportunities after HSE West returned him from an Acting Assistant Director of Nursing post to his substantive role. The recommendation was signed on 20 February 2012. HSE West said the acting post had been suppressed to make savings and cited the public service moratorium. The Court noted the post's suppression was a cost-containment measure. It recommended that, while the moratorium remained in place, the worker should have an opportunity to act up on a rotational basis if an ADON vacancy arose in Mayo Mental Health Services and should be notified of future ADON positions in HSE West Mental Health Services.
