The Labour Court set final terms for staff transferring from the HSE to the Department of Social Protection in a supplemental recommendation dated 27 September 2011. The recommendation followed disputes involving the Services Industrial Professional Technical Union and the Irish Municipal, Public and Civil Trade Union. The Court recommended that transferring staff retain their current pay, superannuation, annual leave and working hours on a personal-to-holder basis. It also recommended deleting “Transition” from certain post titles, provided this had no cost implications. The Court recommended a two-year appeals process for claims that allowances were lost through unfair or arbitrary reassignment of duties. It also recommended that an agreement covering the new grade should prevail where it covered the same matters as an agreement for transferring staff, and that an appeals system be put in place for staff who chose whether to transfer.
