The Labour Court recommended that a Grade IV officer who had worked in a Grade V role for about 11 years have her position addressed under any arrangements agreed in national talks, with priority because of the length of her service in the higher role. The recommendation was signed on 3 May 2011. The Health Service Executive Dublin North East had relied on its policy against awarding incremental credit for acting service. The Court said basic fairness required the worker's position to be regularised, but that it could not be dealt with in isolation from others in similar positions or ahead of the national discussions.
