The Labour Court recommended that Wincanton Ireland pay a worker about €555 for an ADR course and exam fees under a redundancy settlement. The recommendation was signed on 24 March 2011. The worker, represented by the Services Industrial Professional Technical Union (SIPTU), had been made redundant in 2008 after 15 years’ service. The union said a 2006 redundancy agreement covered certain training expenses. Wincanton Ireland did not attend the hearing but sent the Court its position. The Court found that Wincanton had agreed to cover the fees, then withheld payment after learning of an earlier incident it said had not been brought to its attention. The Court said the worker had not had an adequate opportunity to answer the accusations and the agreement did not allow the company to withhold payment.
