The Labour Court recommended that HSE and the Irish Municipal, Public and Civil Trade Union pursue payment of the first phase of a Review Body pay award to eligible staff grades. The recommendation was signed on 31 January 2011. The Court said the grades were entitled to the award, but that there was no substantive dispute for it to decide: both sides agreed it should be paid, while HSE cited technical difficulties and restrictions under the Finance Emergency Measures in the Public Interest (No 2) Act, 2009. The Court suggested the parties use a review provided for in the Public Service Agreement to progress the matter.
