The Labour Court said it was not in a position to consider the Irish Nurses and Midwives Organisation’s claim over pay rates for four midwifery practice development coordinator posts in Band 1 hospitals. The recommendation was signed on 12 January 2011. The union argued the posts should be paid at the Assistant Director of Nursing/Midwifery Band 1 rate because they were in Band 1 hospitals. The Health Service Executive said the posts were aligned to the non-Band 1 rate and the claim was barred as a cost-increasing claim under the Public Service Agreement. The Court relied on clause 1.27 of that agreement.
