The Labour Court rejected the Medical Laboratory Scientists' Association's claim for compensation over medical scientists' lost overtime earnings after the closure of cytology laboratories in Cork and Galway. The recommendation was signed on 7 September 2010. The union said the scientists had lost regular, rostered overtime. The Health Service Executive disputed that the payments were regular and said the earnings had been generated by efforts to clear a substantial backlog. The Court concluded that the overtime and on-call earnings did not qualify as regular and rostered overtime under its usual approach, and recommended against the claim.
