The Labour Court recommended that Tesco Ireland reverse a worker’s final written warning and demotion, restore his former management salary and status retrospectively, and retrain him for an equivalent management role. The recommendation was signed on 23 August 2010. The worker, a Transport Section Manager at Tesco’s Donabate distribution centre, sought the reversal of the sanctions and about €18,750 in lost earnings. Tesco said he had refused a legitimate instruction and later behaved abusively. The Court found the evidence did not substantiate the charges and that the disciplinary procedures were inadequate and unfair.
