The Labour Court recommended an enhanced redundancy payment for a worker at Darke Entertainments Limited Trading As Penny Hill Licensed Premises, following flaws in the dismissal process. The recommendation was signed on 5 May 2010. The worker, represented by Mandate, had been with the Fitzgerald Group for 17 years. He said he offered to take a pay cut to keep his assistant manager job, was not told about other vacancies and another staff member was hired within two weeks of his dismissal. The company said a downturn meant it could not sustain two assistant managers and that the role remained redundant. The Court recommended two weeks’ pay per year of service, in addition to statutory entitlements, in full and final settlement of the claims. The worker had agreed to be bound by the recommendation.
