The Labour Court recommended that an HSE South worker resume his disciplinary appeal within one month of the recommendation dated 26 April 2010, or that it be treated as abandoned. If he resumed it, both sides were to complete the appeal by 25 June 2010. The worker had withdrawn complaints under the Dignity at Work Policy. The worker, an Emergency Medical Technician at the Kilkenny Ambulance base, had challenged the disciplinary process and sanctions following an incident in May 2006. The Court said the process was not exhausted and the proposed sanctions remained on hold pending the appeal. It found management's use of Stage 4 procedures correct and appropriate.
