The Labour Court recommended that Chubb Ireland Ltd pay an anonymised worker €6,000 after finding he was treated more harshly than equally culpable colleagues in a gross-misconduct dismissal.
The recommendation, signed on 21 April 2010, followed the worker’s referral under section 20(1) of the Industrial Relations Act, 1969. The Services Industrial Professional Technical Union represented him.
The worker said the investigation was flawed and he was unfairly blamed for incidents, while Chubb Ireland Ltd said he had failed to carry out his duties and its investigation was fair. The Court found deficiencies in the investigation and questioned whether the company had treated everyone involved evenhandedly. It recommended the payment in full and final settlement of all claims.
