The Labour Court recommended that Darley Enterprises Limited pay an unnamed worker enhanced redundancy terms of two weeks’ average pay per year of service, in addition to statutory redundancy entitlement. The recommendation was signed on 22 April 2010. The worker, an Industrial Relations/Administration Manager, sought six weeks’ pay per year of service inclusive of statutory entitlements after his employment ended in August 2009. Darley Enterprises had offered the statutory minimum and said it was operating in a difficult economic climate. The Court said the circumstances surrounding the termination were unusual compared with normal construction-industry redundancies, and recommended the enhanced terms.
