The Labour Court recommended that existing sick-pay arrangements for fixed-term employees continue until an alternative is agreed, and that the HSE and unions apply Department of Finance Circular 27/03 on annual leave accrual unless they agree otherwise. The recommendation, signed on 13 April 2010, addressed five disputed Rule Book provisions covering sick pay, annual leave, night duty premium and public holidays during sick leave. The Court recommended accepting the Rule Book's night duty arrangement unless an alternative is agreed, and called for further talks on public holidays during sick leave after finding the draft provisions incompatible. Existing arrangements were to continue in the interim.
