The Labour Court recommended an additional redundancy payment for employees made redundant from Federal Security Newco Limited’s Flextronics site in Limerick. The recommendation was signed on 11 January 2010. The Services Industrial Professional Technical Union sought an extra two weeks’ pay per year of service for 21 Security Guards, including five who had already been made redundant. The company said it could not afford an ex-gratia payment after receivership. The Court noted that employees doing identical work for the same employer at an adjacent site had received enhanced terms. It recommended that each employee being made redundant receive, in addition to statutory terms, a lump sum equivalent to the rebate payable from the redundancy fund in that employee’s case. The Court said the recommendation was exceptional and should not be treated as a precedent.
