The Labour Court recommended a lump-sum payment for maintenance staff after a dispute with HSE West and the Technical, Engineering And Electrical Union over subsistence payments for on-call work in Mayo. The recommendation was signed on 9 November 2009. The union said a 1999 agreement provided subsistence payments in addition to travel allowance, while management said a 2006 agreement limited payments to call-outs lasting more than five hours. The Court accepted the 2006 agreement applied but found the union had not known about the significant change and that it had not been openly discussed. It recommended a one-off payment equal to twice the lost subsistence calculated over the 12 months to 30 September 2009, replacing the earlier arrangement.
