The Labour Court recommended that Kingspan Ltd and the Services Industrial Professional Technical Union resume talks on the company's survival plan. The recommendation, signed on 21 August 2009, called for discussions to be completed within eight weeks, with relevant financial information disclosed. The union said the plan would worsen workers' terms and that the first phase of the National Pay Agreement, due from 1 January 2009, remained unpaid. Kingspan said its proposals were needed to improve competitiveness and that pay terms had to be considered alongside the survival plan. The Court said meaningful discussion of the plan had not taken place. It made no recommendation at that time on the pay terms of Towards 2016; any unresolved issues could be referred back to the Court.
