The Labour Court recommended €10,000 compensation for a worker at Na Fianna Ce Scheme Ltd after finding the employer failed in its duty of care by not properly investigating her grievances. It also recommended enhanced redundancy terms under the 2005 FÁS/SIPTU agreement.

The worker, a Community Employment Scheme supervisor, said her position was to be made redundant when the scheme ended and that the employer failed to investigate serious workplace grievances. The employer did not attend the hearing, saying in a written submission that it had addressed the grievances and statutory redundancy.

The Court recommended severance of 3.35 weeks’ pay per year of service, in addition to statutory entitlements. It signed the recommendation on 7 August 2009. The Court said an independent investigation was no longer practicable.
