The Labour Court recommended against the Services Industrial Professional Technical Union’s claim for a former Rehabcare worker to receive the final 25% phase of a benchmarking award. The recommendation was signed on 5 May 2009. The union argued that earlier phases had been paid late and retrospectively. Rehabcare said the final phase had different conditions and required each worker to agree to cooperate with a performance verification process. The worker left Rehabcare before the payment date and had not joined that process. The Court accepted that payment of the final phase depended on individual cooperation with the process and found that the worker did not meet the criteria.
